Qelaj,<\/p>\n\n\n\n<p>N\u00eb em\u00ebr t\u00eb organizatave t\u00eb shoq\u00ebris\u00eb civile t\u00eb n\u00ebnshkruara m\u00eb posht\u00eb, ju drejtohemi me k\u00ebt\u00eb nism\u00eb p\u00ebr paraqitjen e nj\u00eb K\u00ebrkese n\u00eb Gjykat\u00ebn Kushtetuese p\u00ebr vler\u00ebsimin e kushtetutshm\u00ebris\u00eb s\u00eb nenit 32.1 t\u00eb Ligjit p\u00ebr Noterin\u00eb (06\/L-010). Ne konsiderojm\u00eb se ky nen nuk \u00ebsht\u00eb n\u00eb p\u00ebrputhje me dispozitat e Kushtetut\u00ebs s\u00eb Kosov\u00ebs, e cila garanton p\u00ebrdorimin e barabart\u00eb t\u00eb gjuh\u00ebve shqipe dhe serbe si gjuh\u00eb zyrtare n\u00eb Kosov\u00eb. Gjithashtu, mendojm\u00eb se praktika aktuale e pun\u00ebs s\u00eb noter\u00ebve n\u00eb Kosov\u00eb nuk \u00ebsht\u00eb n\u00eb p\u00ebrputhje me dispozitat e Kushtetut\u00ebs, Ligjin p\u00ebr P\u00ebrdorimin e Gjuh\u00ebve dhe ndalimin e diskriminimit, t\u00eb garantuar nga Kushtetuta e Kosov\u00ebs dhe konventat nd\u00ebrkomb\u00ebtare p\u00ebr t\u00eb drejtat e njeriut.<\/p>\n\n\n\n<p>Neni i p\u00ebrmendur 32.1 i Ligjit p\u00ebr Noterin\u00eb p\u00ebrcakton se \u201cT\u00eb gjitha dokumentet noteriale l\u00ebshohen n\u00eb gjuh\u00ebn shqipe ose serbe, n\u00eb var\u00ebsi t\u00eb gjuh\u00ebs q\u00eb e njeh m\u00eb mir\u00eb noteri q\u00eb p\u00ebrpilon dokumentin\u201d. Sipas nesh, kjo dispozit\u00eb p\u00ebrb\u00ebn\u00eb mohim t\u00eb drejtp\u00ebrdrejt t\u00eb nenit 5.1 t\u00eb Kushtetut\u00ebs s\u00eb Kosov\u00ebs dhe p\u00ebr k\u00ebt\u00eb arsye \u00ebsht\u00eb e nevojshme ndryshimi dhe plot\u00ebsimi i k\u00ebsaj dispozite n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb p\u00ebrcaktohet se \u201cdokumentet noteriale l\u00ebshohen n\u00eb gjuh\u00ebn e pal\u00ebs\u201d, ashtu si\u00e7 \u00ebsht\u00eb detyrim p\u00ebr t\u00eb gjitha institucionet q\u00eb ofrojn\u00eb sh\u00ebrbime publike.<\/p>\n\n\n\n<p>Gjithashtu, paragraf\u00ebt 2 dhe 3 t\u00eb nenit 32 t\u00eb Ligjit p\u00ebr Noterin\u00eb p\u00ebrcaktojn\u00eb se, n\u00eb nivel komunal, pal\u00ebt kan\u00eb t\u00eb drejt\u00eb t\u00eb k\u00ebrkojn\u00eb nj\u00eb kopje t\u00eb dokumentit n\u00eb gjuh\u00ebn q\u00eb d\u00ebshirojn\u00eb, si dhe q\u00eb p\u00ebrpilimit t\u00eb dokumentit t\u2019i asistoj\u00eb nj\u00eb p\u00ebrkthyes. Megjithat\u00eb, n\u00eb praktik\u00eb, kjo e drejt\u00eb degradohet nga nj\u00eb e drejt\u00eb n\u00eb nj\u00eb mund\u00ebsi, pasi pala detyrohet t\u00eb paguaj\u00eb p\u00ebr sh\u00ebrbimin e p\u00ebrkthyesit, p\u00ebrkat\u00ebsisht t\u00eb p\u00ebrkthyesit t\u00eb autorizuar gjyq\u00ebsor.<\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb drejtim, theksojm\u00eb se Kushtetuta e Kosov\u00ebs p\u00ebrcakton se: \u201cGjuh\u00ebt zyrtare n\u00eb Republik\u00ebn e Kosov\u00ebs jan\u00eb gjuha shqipe dhe gjuha serbe\u201d (neni 5.1). Gjithashtu, Ligji p\u00ebr P\u00ebrdorimin e Gjuh\u00ebve (02\/L-037) p\u00ebrcakton se \u201cGjuha shqipe dhe gjuha serbe dhe alfabetet e tyre jan\u00eb gjuh\u00eb zyrtare n\u00eb Kosov\u00eb dhe kan\u00eb status t\u00eb barabart\u00eb n\u00eb institucionet e Kosov\u00ebs\u201d (neni 2.1). Bazuar n\u00eb analiz\u00ebn e kushtetut\u00ebs, ligjeve dhe praktik\u00ebs s\u00eb zyrave noteriale n\u00eb Kosov\u00eb, kemi arritur n\u00eb p\u00ebrfundimin se t\u00eb drejtat e serb\u00ebve p\u00ebr p\u00ebrdorimin e gjuh\u00ebs serbe si gjuh\u00eb zyrtare po shkelen, p\u00ebrkund\u00ebr garancive kushtetuese.<\/p>\n\n\n\n<p>N\u00eb praktik\u00ebn e pun\u00ebs s\u00eb noter\u00ebve n\u00eb Kosov\u00eb ekziston diskriminim sistematik ndaj komuniteteve jo-shumic\u00eb, n\u00eb ve\u00e7anti komunitetit serb, pasi dokumentet noteriale l\u00ebshohen ekskluzivisht n\u00eb gjuh\u00ebn shqipe, nd\u00ebrsa p\u00ebrkthimi n\u00eb gjuh\u00ebn serbe mbetet barr\u00eb e pal\u00ebs. Kjo duket t\u00eb jet\u00eb pasoj\u00eb e paqart\u00ebsis\u00eb s\u00eb Ligjit p\u00ebr Noterin\u00eb, p\u00ebrkat\u00ebsisht nenit 32, i cili u jep t\u00eb drejt\u00ebn noter\u00ebve t\u00eb vendosin n\u00eb cil\u00ebn nga dy gjuh\u00ebt zyrtare do t\u00eb p\u00ebrpilojn\u00eb dokumentin, pa p\u00ebrcaktuar q\u00eb p\u00ebrkthimi n\u00eb gjuh\u00ebn tjet\u00ebr zyrtare \u2013 n\u00eb k\u00ebt\u00eb rast gjuh\u00ebn serbe \u2013 duhet t\u00eb mbulohet nga buxheti i Kosov\u00ebs.<\/p>\n\n\n\n<p>Rrjedhimisht, kemi arritur n\u00eb p\u00ebrfundimin se e drejta e garantuar me Kushtetut\u00eb p\u00ebr sh\u00ebrbime n\u00eb gjuh\u00ebn serbe, si gjuh\u00eb zyrtare e barabart\u00eb n\u00eb Kosov\u00eb, \u00ebsht\u00eb duke u kufizohuar p\u00ebrmes detyrimit p\u00ebr t\u00eb paguar p\u00ebr sh\u00ebrbimet e p\u00ebrkthyesve gjyq\u00ebsor\u00eb me t\u00eb cil\u00ebt bashk\u00ebpunojn\u00eb noter\u00ebt. Kjo praktik\u00eb p\u00ebrfshin\u00eb p\u00ebrkthimin konsekutiv (p\u00ebrkthim me goj\u00eb) t\u00eb dokumentit si dhe p\u00ebrkthimin me shkrim sipas k\u00ebrkes\u00ebs s\u00eb pal\u00ebs. N\u00eb lidhje me k\u00ebt\u00eb p\u00ebrfundim, theksojm\u00eb se neni 2.1 i Ligjit p\u00ebr Noterin\u00eb p\u00ebrcakton se \u201cNoteria \u00ebsht\u00eb sh\u00ebrbim publik i cili ushtrohet nga noter\u00ebt e em\u00ebruar nga ministri i drejt\u00ebsis\u00eb (n\u00eb tekstin e m\u00ebtejm\u00eb: ministri) n\u00eb p\u00ebrputhje me dispozitat e k\u00ebtij ligji.\u201d Kjo dispozit\u00eb \u00ebsht\u00eb n\u00eb p\u00ebrputhje me faktin se sh\u00ebrbimet noteriale jan\u00eb transferuar nga gjykatat te noter\u00ebt n\u00eb Kosov\u00eb.<\/p>\n\n\n\n<p>Prandaj, t\u00eb gjitha institucionet q\u00eb ofrojn\u00eb sh\u00ebrbime publike n\u00eb Kosov\u00eb jan\u00eb t\u00eb obliguara t\u2019i ofrojn\u00eb ato n\u00eb t\u00eb dyja gjuh\u00ebt zyrtare n\u00eb m\u00ebnyr\u00eb t\u00eb barabart\u00eb, ashtu si\u00e7 p\u00ebrcaktohet me Kushtetut\u00ebn dhe Ligjin p\u00ebr P\u00ebrdorimin e Gjuh\u00ebve. \u00c7do praktik\u00eb n\u00eb kund\u00ebrshtim me k\u00ebt\u00eb p\u00ebrb\u00ebn\u00eb shkelje t\u00eb t\u00eb drejtave t\u00eb garantuara me Kushtetut\u00eb dhe ligj, si dhe diskriminim t\u00eb ndaluar si nga Kushtetuta e Kosov\u00ebs ashtu edhe nga konventat nd\u00ebrkomb\u00ebtare.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Duke pasur parasysh t\u00eb lartp\u00ebrmendurat, propozojm\u00eb sa vijon:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Paraqitjen e K\u00ebrkes\u00ebs n\u00eb Gjykat\u00ebn Kushtetuese p\u00ebr vler\u00ebsimin e kushtetutshm\u00ebris\u00eb s\u00eb nenit 32.1 t\u00eb Ligjit p\u00ebr Noterin\u00eb, n\u00eb p\u00ebrputhje me nenin 113.2.1 t\u00eb Kushtetut\u00ebs s\u00eb Kosov\u00ebs.<\/li>\n\n\n\n<li>Nism\u00eb p\u00ebr ndryshimin dhe plot\u00ebsimin e Ligjit p\u00ebr Noterin\u00eb, ve\u00e7an\u00ebrisht nenit 32.1, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb p\u00ebrcaktohet se dokumentet noteriale duhet t\u00eb l\u00ebshohen n\u00eb gjuh\u00ebn e pal\u00ebs\/pal\u00ebve.<\/li>\n\n\n\n<li>D\u00ebrgimin e shkresave institucioneve kompetente n\u00eb lidhje me detyrimin p\u00ebr ofrimin e sh\u00ebrbimeve publike n\u00eb gjuh\u00ebn serbe, p\u00ebrkat\u00ebsisht institucioneve n\u00eb vijim: Qeveris\u00eb s\u00eb Kosov\u00ebs, Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb, Od\u00ebs s\u00eb Noter\u00ebve dhe, krejt\u00ebsisht n\u00eb fund, t\u00eb gjith\u00eb noter\u00ebve n\u00eb Kosov\u00eb.<\/li>\n<\/ol>\n\n\n\n<p>Presim p\u00ebrgjigjen tuaj lidhur me k\u00ebt\u00eb nism\u00eb dhe ju fal\u00ebnderojm\u00eb paraprakisht.<\/p>\n\n\n\n<p>Mitrovic\u00eb&nbsp;Veriore,<\/p>\n\n\n\n<p>25 qershor 2025.<\/p>\n\n\n\n<p>N\u00ebnshkruesit e iniciativ\u00ebs:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>OJQ\u00a0ACDC\u00a0Qendra\u00a0Avokuese p\u00ebr\u00a0Kultur\u00eb Demokratike\u00a0<\/li>\n\n\n\n<li>OJQ Aktiv<\/li>\n\n\n\n<li>OJQ\u00a0CASA\u00a0Qendra p\u00ebr Veprim Social Afirmativ\u00a0<\/li>\n\n\n\n<li>OJQ\u00a0NSI\u00a0Iniciativa e Re Sociale<\/li>\n\n\n\n<li>OJQ\u00a0InTER Instituti p\u00ebr Zhvillim Ekonomik Territorial\u00a0<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Institucionit t\u00eb Avokatit t\u00eb Popullit n\u00eb Kosov\u00ebL\u00ebnda: Nism\u00eb p\u00ebr paraqitjen e k\u00ebrkes\u00ebs n\u00eb Gjykat\u00ebn Kushtetuese p\u00ebr vler\u00ebsimin e ligjshm\u00ebris\u00eb I nderuar z.
