N\u00eb t\u00eb gjitha rastet, b\u00ebhet fjal\u00eb p\u00ebr persona me shtet\u00ebsi t\u00eb dyfisht\u00eb, t\u00eb cil\u00ebt p\u00ebrkat\u00ebsisht p\u00ebrpos shtet\u00ebsis\u00eb s\u00eb Kosov\u00ebs, kan\u00eb edhe shtet\u00ebsin\u00eb e Republik\u00ebs s\u00eb Serbis\u00eb, gj\u00eb q\u00eb lejohet nga Kushtetuta dhe ligjet n\u00eb fuqi n\u00eb Kosov\u00eb.<\/p>\n\n\n\n<p>Sipas informacioneve t\u00eb b\u00ebra publike, Ministria e ka bazuar k\u00ebt\u00eb vendim n\u00eb nenin 24 t\u00eb Ligjit p\u00ebr shtet\u00ebsin\u00eb (2014), i cili parasheh mund\u00ebsin\u00eb e heqjes s\u00eb shtet\u00ebsis\u00eb p\u00ebr ata q\u00eb sh\u00ebrbejn\u00eb n\u00eb struktura t\u00eb siguris\u00eb t\u00eb nj\u00eb shteti t\u00eb huaj pa leje paraprake nga autoritetet e Kosov\u00ebs.<\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb drejtim, shprehim shqet\u00ebsimin ton\u00eb t\u00eb thell\u00eb n\u00eb lidhje me m\u00ebnyr\u00ebn e aplikimit t\u00eb k\u00ebsaj dispozite:<\/p>\n\n\n\n<p>\u25cf Asnj\u00eb nga personat e prekur nuk \u00ebsht\u00eb privuar formalisht nga shtet\u00ebsia e Kosov\u00ebs para deportimit. Pavar\u00ebsisht se jan\u00eb qytetar\u00eb t\u00eb Kosov\u00ebs, deportimi i tyre pa vendim gjyq\u00ebsor p\u00ebrb\u00ebn shkelje t\u00eb drejtp\u00ebrdrejt\u00eb t\u00eb Kushtetut\u00ebs dhe t\u00eb konventave nd\u00ebrkomb\u00ebtare q\u00eb garantojn\u00eb t\u00eb drejt\u00ebn p\u00ebr proces t\u00eb rregullt gjyq\u00ebsor (neni 6 i Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut), si dhe ndalojn\u00eb d\u00ebbimin e shtetasve t\u00eb vet (neni 3 i Protokollit nr. 4 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut).<\/p>\n\n\n\n<p>\u25cf P\u00ebrve\u00e7 privimit t\u00eb kund\u00ebrligjsh\u00ebm nga shtet\u00ebsia, k\u00ebtyre personave u \u00ebsht\u00eb ndaluar hyrja n\u00eb territorin e Kosov\u00ebs p\u00ebr nj\u00eb periudh\u00eb t\u00eb gjat\u00eb kohore, pa procedur\u00eb gjyq\u00ebsore dhe pa vendim gjyq\u00ebsor t\u00eb form\u00ebs s\u00eb prer\u00eb, duke shkelur k\u00ebshtu t\u00eb drejt\u00ebn e tyre p\u00ebr liri t\u00ebl\u00ebvizjes, t\u00eb mbrojtur me nenin 2 t\u00eb Protokollit nr. 4 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut.<\/p>\n\n\n\n<p>\u25cf Procedurat u zhvilluan pa mund\u00ebsin\u00eb e mjetit juridik efektiv me efekt pezullues, ndesh me t\u00eb drejtat e garantuara nga nenet 6 dhe 13 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut.<\/p>\n\n\n\n<p>\u25cf Ligji u aplikua menj\u00ebher\u00eb pas nj\u00eb incidenti t\u00eb natyr\u00ebs politike dhe t\u00eb siguris\u00eb, gj\u00eb q\u00eb p\u00ebrforcon p\u00ebrshtypjen e krijuar p\u00ebr zbatim selektiv dhe t\u00eb motivuar politikisht t\u00eb ligjit, pa vler\u00ebsim individual t\u00eb secilit rast.<\/p>\n\n\n\n<p>\u25cf Deportimi ka pasoja serioze p\u00ebr familjet dhe komunitetin e k\u00ebtyre individ\u00ebve, duke cenuar edhe t\u00eb drejt\u00ebn p\u00ebr jet\u00eb familjare dhe private, t\u00eb garantuar me nenin 8 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Bashk\u00eblidhur me k\u00ebt\u00eb let\u00ebr, ju paraqesim nj\u00eb memorandum ligjor q\u00eb p\u00ebrmban fragmente nga konventat nd\u00ebrkomb\u00ebtare p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut, t\u00eb cilat jan\u00eb pjes\u00eb e rendit juridik t\u00eb brendsh\u00ebm t\u00eb Kosov\u00ebs, si dhe nga Kushtetuta e Kosov\u00ebs.<\/p>\n\n\n\n<p>K\u00ebrkesat tona jan\u00eb si m\u00eb posht\u00eb:<\/p>\n\n\n\n<p>1. Fillimi i nj\u00eb hetimi dhe vler\u00ebsimi t\u00eb pavarur p\u00ebr ligjshm\u00ebrin\u00eb e deportimeve t\u00eb realizuara;<\/p>\n\n\n\n<p>2. Shqyrtimi i shkeljeve t\u00eb mundshme t\u00eb t\u00eb drejtave t\u00eb njeriut t\u00eb qytetar\u00ebve t\u00eb prekur;<\/p>\n\n\n\n<p>3. Dh\u00ebnia e rekomandimeve institucioneve kompetente p\u00ebr nd\u00ebrprerjen e k\u00ebsaj praktike dhe parandalimin e rasteve t\u00eb ngjashme n\u00eb t\u00eb ardhmen.<\/p>\n\n\n\n<p>Ne besojm\u00eb se institucionet dhe organizatat t\u00eb cilave po u drejtohemi kan\u00eb rol ky\u00e7 n\u00eb mbrojtjen e sundimit t\u00eb ligjit dhe t\u00eb t\u00eb drejtave t\u00eb njeriut n\u00eb Kosov\u00eb, ve\u00e7an\u00ebrisht n\u00eb kontekstin e politizimit dhe heqjes s\u00eb t\u00eb drejtave t\u00eb garantuara kushtetuese t\u00eb komuniteteve jo-shumic\u00eb.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Me respekt,<\/p>\n\n\n\n<p>1. \u017densko Pravo (T\u00eb drejtat e grave)<\/p>\n\n\n\n<p>2.
